By submitting an entry for this challenge, you are deemed to have read, understood and agree to abide by the Terms & Conditions set out by the Organiser.

Modern Aging Photography Contest 2018 Terms and Conditions Contest Rules and Eligibility 1. The Modern Aging Photography Contest (the "Contest") is open to all individuals legally residing in Singapore who are aged 16 and over as of 1 January 2018 (e.g. Singapore Citizens, Permanent Residents, Employment Pass holders, Work Permit holders, Student Pass holders) 2. Modern Aging Singapore is a program jointly organized by ACCESS Health International South East Asia Ltd and National University of Singapore acting through its NUS Enterprise. 3. The Contest commences on 1 Aug 2018 and closes at 11.59pm on 1 November 2018. Images submitted after the deadline will not be considered. The organisers reserve the right in their absolute discretion to extend the closing date for a reasonable period of time where an insufficient number of the entries received have satisfied the entry and judging criteria. 4. By entering the Contest, the participant ("You") will be regarded as having accepted and agreed to be bound by the terms and conditions of the Contest. The organisers reserve the right of final judgment concerning items not expressly stated in these terms and conditions. 5. In submitting Your entry, You must abide by the following rules of the Contest. If You have any questions about how to enter or in connection with the Contest, please send an e-mail to [email protected] • Images can be photographed in a style of your choice and with any equipment of your choice (smartphones included). • Images must be submitted in high-resolution JPEG, above 4MB in size and at least 3000 x 2000px (150 to 300dpi). • Images retouched by software, including a camera or photo editing app, will be accepted. • Images can be in either monochrome or colour. • There is no date or time restriction on when or where the image was taken. • Stock or copyrighted images will not be accepted. The organisers reserve the right to reject entries that are identical or similar to copyrighted work. • Works that have won prizes in other contests or that have been submitted to other contests currently underway, including similar works, are not eligible. Works that are entered in other competitions after submitting to this contest will be deemed as those having been submitted to other contests currently underway. • Images with watermarks or signatures will not be accepted. Borders should be avoided unless they are an inherent part of the image (i.e. instant film or traditional process images). 6. A maximum of 2 entries is permitted per participant. 7. Entries on behalf of another person will not be accepted and joint submissions are not allowed. Entries must be made by the authorized account holder of the email address submitted. 8. Contest entries will only be accepted via Entries that do not contain the required information or are submitted via any other channel will not be accepted. The organisers are not responsible for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered into the Contest for any technical or other reason. 9. You are responsible for the cost (if any) of creating and submitting your contest entries, as well as all other costs associated with your participation in the Contest. Copyrights and Use 10. Each image submitted must be the original work and unpublished of the participant who must also be its copyright owner. The participant shall retain the copyright to the image(s) submitted in the Contest. 11. By submitting an entry to the Contest, You will be regarded as having granted the organisers: a. Permission for Your entry to be published on the Modern Aging websites and the non-exclusive, royalty-free, worldwide license to use and publish Your Contest entry in electronic format (including on the Modern Aging website) and hard copy (including Modern Aging publications), purposes connected with the Contest, and to adapt the entry to enable such publication (including to shorten or edit it for such purposes), and You hereby irrevocably waive, for the benefit of the organisers, all moral rights in the entry to which You are entitled. Such publication does not guarantee an award of any kind. b. The right to use Your name, image(s) and town or city of residence for the sole purpose of identifying You as the author of Your entry and/or as a finalist or winner of the Contest. 12. Your entry must only feature You and, if appropriate, other people aged 16 and over with their permission. The entry must be Your own work, never before published, must not be copied, must not contain any third-party materials and/or content that You do not have permission to use, must not promote Your own or third party goods or services or include any trade marks (other than those belonging to Modern Aging), and must not show inappropriate or dangerous behavior, or otherwise be obscene, defamatory, distasteful, offensive, or in breach of any applicable legislation or regulations, or in breach of any confidentiality obligations owed by You to third parties. If the organisers have reason to believe Your entry is not Your own work, if a person objects to the inclusion of your entry in which they are featured being included in the Contest, or if Your entry otherwise breaches the Terms and Conditions of the Contest, the organisers reserve the right to reject and disqualify the entry. Content of all images submitted is Your responsibility. You must obtain all relevant model and/or property releases. It is not the responsibility of the organisers to obtain model and/or property release forms or to assure/examine the protection of infringement rights. Disqualification 13. The organisers have the right to disqualify Your entry if You i) do not meet the entry criteria, ii) You violate copyrights and/or personality rights iii) You cannot be contacted, iv) You do not respond within five working days of being contacted by the organisers in relation to Your entry. In the event of disqualification, the organisers may select a new winner in accordance with the selection processes below. 14. In the event that a winner is found to be disqualified after a prize is awarded, the award may be revoked and the participant shall then promptly return the prize.   Selection and Final Event 15. Seven winners will be selected at the end of the challenge period at the discretion of the organisers. Winning participants will be chosen on their fulfilment of challenge requirements and that he/she has submitted valid contact details. 16. The Modern Aging Finale event will be held on 30 November 2018 in Singapore. All winners will have their photographs exhibited and are invited to attend to receive their awards. If a winner is unable to attend the Finale event, they may appoint a representative to attend on their behalf. 17. When choosing the winners, judging will be based upon the following criteria i) Photo clearly communicates the contest theme, ii) Photo quality and aesthetics, iii) Quality of title and caption. 18. The organisers’ determination as to the winners is final and no correspondence or appeals will be entertained. The participants shall accept and abide by any and all decisions made by the Organiser concerning, without limitation, the T&Cs, the rules, procedures and regulations of the Challenge, the award of the rewards and any other matters relating to the challenge. 19. Winners will be announced via the challenge page to the public by 25 November 2018. An e-mail (provided when signing up with Markedshot) will also be sent to winning participant informing of his/her winning status and details on prize redemption. Prize and Recognition 20. The 1st, 2nd and 3rd prize winners will receive cash prizes of SGD$500, SGD$200 and SGD$100 respectively. There will be four consolation prizes of SGD$50 each. Each winner will need to sign a prize acceptance agreement before he/she is entitled to receive the cash prize payable via bank transfer to the winner’s bank account. 21. The winners will be notified by the organisers via e-mail. If a winner rejects his or her prize, then the winner's prize shall be forfeited and the organisers shall be entitled (but not obliged) to select another winner. 22. The winner's prize will be paid within 14 days after signing the prize acceptance agreement. The agreement will be sent to the winner within one week after the finale event. 23. The winners may be required for promotional activity and shall participate in such activity on the organisers’ reasonable request. The winners consent to the use by the organisers, both before and after the closing date of the Contest for an unlimited time, of their voice, image, photograph and name for publicity purposes (in any medium, including still photographs and films, and on the internet, including any websites hosted by the organisers and their related companies) and in advertising, marketing or promotional material without additional compensation or prior notice and by participating in the Contest, all participants shall be deemed as having consented to the same. Use of personal information 24. By entering into the Contest, You agree to the collection, retention, usage and distribution of Your personal information in order to process and contact You about Your Contest entry, and for the purposes outlined in the paragraphs above. 25. The organisers may transfer Your details to third parties and/or otherwise engage third party providers in connection with this Contest where the third party is acting on the organisers’ behalf for the purposes of administering this Contest and/or any subsequent publicity, and/or for the purposes of sending You relevant marketing materials; and/or as otherwise required by law. Liability 26. The organisers shall not be responsible or liable for any damage, loss, liabilities, injury or disappointment incurred or suffered by You as a result of entering the Contest or accepting any prize. The organisers further disclaim liability for any injury or damage to You or any other person's computer relating to or resulting from participation in or downloading any materials in connection with the Contest. 27. You agree to fully indemnify the organisers and accept all responsibility for any third-party complaints or objections concerning copyright or any other intellectual property rights infringement or damages arising from the works submitted. Other Terms 28. The organisers reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Contest with or without prior notice due to reasons outside their control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of the organisers in all matters under its control is final and binding. 29. Any complaints regarding the Contest should be sent to [email protected] 30. The Contest and these terms and conditions will be governed by the laws of Singapore and shall be subject to the exclusive jurisdiction of the courts of Singapore.

    Rules and Regulations

  1. This challenge is organised by NUS Enterprise (“Organiser”). Employees of any third party vendors engaged by the Organiser for purposes of the challenge are eligible to enter the challenge but shall not be eligible to receive any prizes. The winners of the challenge may be required to sign a written statement confirming his/her eligibility/identity before rewards redemption.

  2. Participation in the challenge is subject to these Terms and Conditions (“T&Cs”). By participating in the challenge, each participant agrees to be bound by and to comply with the T&Cs and is deemed to accept the T&Cs and any amendments, additions, replacements, variations and modifications hereto, which shall be final and binding in all respects on each participant. Amendments to the T&Cs will be posted on via the original challenge link.

  3. Only a natural person who is the authorised account holder of his/her Markedshot account at the time of submission will be considered the participant and he/she will be required to comply with the T&Cs. Participants may be required to show proof of being the authorised account holder of their respective account. In the event that any participant is below 18 years of age, such participant must obtain consent from his/her parent or legal guardian prior to entering the challenge. The Organiser reserves the right to verify, at any time, that such consent has been obtained.

  4. Duration

  5. The challenge will be conducted within the period stated in challenge details page. Submissions to challenge before or after the stated challenge period will not be valid.

  6. Participation

  7. To participate and submit a photo in the challenge, the Participant is required to sign up for a Markedshot account.

  8. Each Participant is allowed to submit multiple submissions unless otherwise stated so. In the case of single submission only challenge, only the last submission will be valid.

  9. To participate in the Challenge, a participant is required to:

    1. Follow requirements set up by Organiser in Challenge page;

    2. Like / Follow Organiser's Social Media account if required;

    3. Include the relevant Hashtags if required;

    4. Include location of submitted photo if required;

    5. Ensure their Instagram account is set to public if required;

    6. Share the challenge on his/her own social media account if required;

    7. Any or other requirements stated by Organiser for a valid Photo Challenge submission.

  10. Each participant agrees:

    1. to post photo that are not libellous, defamatory, threatening, pornographic, obscene, indecent, lewd, abusive, illegal, political, racist, religious, blasphemous, false, an infringement of any intellectual property rights of a third party, and do not otherwise violate or encourage the violation of any laws of Singapore (including the Official Secrets Act (Cap.213) and the Personal Data Protection Act 2012) and/or any laws of the participant’s country of residence (collectively, “Applicable Laws”) or any proprietary or other rights of any third party; and

    2. to take the photo from an area to which public entry is permitted. Illegal or attempted illegal entry of any properties owned or managed by participant is strictly prohibited. For the avoidance of doubt, entry into the Challenge does not grant the participant the right to enter any private property if the participant does not already have the legal right to do so.

    3. The Participant shall indemnify and keep Markedshot and NUS Enterprise and persons or entities authorised by it fully indemnified against any and all losses, actions, liabilities, claims, proceedings, costs, expenses and damages arising out of any breach of the above warranty in Point 8a/8b.

    4. Agrees that if any photo submitted by the participant features any person other than the participant, the participant will obtain a model release (if requested) from each such person irrevocably agreeing to the Organiser using the photo, without compensation, in perpetuity, in any country of the world, in any manner and in any media or format now know or later devised, for any purpose whatsoever. The Organiser reserves the right to disqualify any entry, and/or forfeit, withhold, withdraw or reclaim any prizes; in the event such release is requested by the Organiser but is not provided;

  11. Rewards

  12. 7 winners will be selected at the end of the challenge period at NUS Enterprise's discretion. Winning participants will be chosen on their fulfilment of challenge requirements and that he/she has submitted valid contact details.

  13. The Organiser will determine the winners of the Photo Challenge. The Organiser’s determination as to the winner is final and no correspondence will be entertained. The participants shall accept and abide by any and all decisions made by the Organiser concerning, without limitation, the T&Cs, the rules, procedures and regulations of the Challenge, the award of the rewards and any other matters relating to the challenge.

  14. Winners will be announced via the challenge page to the public within a maximum period of 1 month from end of challenge. An email (provided when signing up with Markedshot) and/or push notifications (if enabled by participant) will also be sent to winning participant informing of his/her winning status and details on rewards redemption.

  15. Upon receiving a response from the winner with regards to the prize collection, rewards must be redeemed within two weeks of the acknowledgement.

  16. If any Participant fails to respond within 1 week after the email regarding the collection of the prizes is sent, for any reason whatsoever, NUS Enterprise reserves the right to forfeit the rewards.

  17. NUS Enterprise shall forfeit the rewards not claimed by any Participant after the above-stipulated dates and award them to the subsequent winners.

  18. NUS Enterprise reserves the right to substitute or replace the rewards with any other items of similar value without prior notice.

  19. NUS Enterprise decision in selecting the winners and determining the rewards are final and no appeals will be accepted or entertained.

  20. Rewards are non-transferable, non-negotiable and non-exchangeable.

  21. NUS Enterprise reserves the right to use winning entries as described in Intellectual Property section even if winner fails to redeem the rewards.

  22. Intellectual Property and Publicity Rights

  23. The intellectual property rights of the entries submitted for this challenge shall remain with the respective Participant. However should Participant’s photo be selected as a winning entry, he/she irrevocably grants to the Organiser, should the photo be a winning photo, the right and license to use the winner’s photo and all materials submitted by the participant, including the winner’s name and likeness (collectively, “Participant’s Materials”), without compensation, in perpetuity, in any country of the world, in any manner and in any media or format now known or later devised, for any purpose whatsoever. Winning participant grants a royalty-free, non-exclusive, worldwide, irrevocable, perpetual license to NUS Enterprise to feature any or all of the submissions in their publications, website and/or in any promotional materials currently held or in the future.

  24. Markedshot and NUS Enterprise reserves the right to record and publish any of the events or activities of the Challenge for broadcast and promotional purposes without the participant's prior consent or giving any form of payment and retains the right to any material recorded or published as part of this process.

  25. Each winner consents to the public disclosure of his/her name, and winning submission, as the case may be, for publicity purposes or otherwise participates in the publicity activities of NUS Enterprise in relation to the Challenge and to the use of any data provided by such winner for any future publicity effort by NUS Enterprise, without any payment or compensation thereof.

  26. Any and all personal data submitted may be collected, used and/or disclosed to the Organiser and its related corporations in accordance with their privacy policy (the “Privacy Policy”) for various purposes, including to communicate with the participant for purposes related to the Challenge, to provide goods and services to the participant upon request, to send to the participant marketing information on products and services offered by the Organiser or other parties, the purposes set forth in the Privacy Policy, and such other purposes as the Organiser and its related corporations may reasonably deem appropriate including for such promotional, marketing, publicity, research, profiling, authentication and verification purposes as the Organiser sees fit, including but not limited to the promotion of the business, products and services of the Organiser and/or its related corporations, or in relation to which the participant has otherwise provided the Organiser or its related corporations with consent.

  27. Markedshot shall have the discretion to remove all submitted entries which contains irrelevant or offensive content.

  28. Governing Laws

  29. These Terms and Conditions and all its subsequent variations shall be subject to, governed by and interpreted in accordance with the domestic Laws of the Republic of Singapore which Markedshot is incorporated in or whereby the country Challenge is conducted in.

  30. Liabilities and Discretions

  31. Participants shall be deemed to have waived the right to assert any and all costs of verification and redemption after receiving their rewards and any loss, damage, cost, expense or other liability, whether under contract, tort or any other principle of liability whatsoever, which arise directly or indirectly after receiving their rewards. Any and all applicable taxes on any rewards are the sole responsibility of the Photo Challenge winners.

  32. Notwithstanding anything in these Terms and Conditions, NUS Enterprise reserves the right at any time in its absolute discretion to determine and/or amend, by addition to, subtraction from or variation of, these Terms and Conditions without prior notification.

  33. NUS Enterprise and Markedshot reserves the right to disqualify any participant who fails to comply with any of the Terms and Conditions.

  34. In the event of any inconsistency between these Terms and Conditions and any marketing or promotional materials relating to the Challenge, these Terms and Conditions, and all its subsequent variations, shall prevail.
